    WAKA: Andalusia Police Officer Convicted Of Harrassment (Oct 21 2013)

    Officer Rodrick Covington, has been sentenced to 30 days in the county jail and fines after Covington used fighting language against Agent David Harrell II. Court documents state Covington knew he was not welcome at the Drug Task Force and refused to leave Harrell's office. The court order also states there is evidence of a troubling relationship between the Covington County Drug Task Force and the Andalusia Police Department.

    Case has been scheduled to be heard Thursday, March 14th, 2013 at 3:00 p.m. in Covington County District Court. Covington County District Attorney Walt Merrell whose office also prosecutes cases for the plaintiff(s) and defendant has recused himself and his office from prosecuting the cases and has requested assistance from Houston County District Attorney Doug Valeska in prosecuting this cases.

    Additionally, Judge Frank “Trippy” McGuire and Judge Charles “Lex” Short have also recused themselves from hearing the cases.

    WAAO is unsure if the case will actually be heard in Covington County Court on the scheduled date of Thursday, March 14th, 2013 at 3:00 p.m.

    We have also learned the one of the parties in this case has requested the court be closed to the public due to one of the witnesses involved is reportedly a confidential informant. WAAO is unsure if that request will honored by the court.

    The original complaints were filed on January 17th, 2013 after an incident that allegedly occurred at the Drug task Force Office north of Andalusia near the Andalusia Industrial Park. (see original WAAO Facebook storyline)

    Plaintiffs Harrell and Hart, both in sworn warrant affidavits, allege Andalusia Police Sergeant Investigator, Roderick Covington Aka: R.C. harassed them by means of verbal communication.

    Additional details begin to emerge surrounding the arrest of Andalusia Police Investigator Sergeant Roderick Christopher Covington Aka: R.C.

    Below is the text of the sworn warrant affidavit filed with the Covington County Circuit Clerk’s Office by Drug Task Force employee

    Warrant/Summons Number - 13-47

    Case Number – 000130100491

    Defendents Name- Roderick Covington AKA: RC Andalusia Police Department

    "Statement of : ____________(DTF employee)"

    On January 16, 2013, (APD Investigator #504 and APD Investigator #503) came to the 22nd Judicial Drug Task Force office at around 9:15 am and needed to use or buy equipment to make a buy using one of their CI’s. (APD Inv.#504) contacted his CI (confidential informant) and told him to meet them here at the Task Force office. While they were here I (DTF employee) told them at the Task Force did not mind working with anyone from Andalusia Police Department. I (DTF employee) told them the only one we refused to work with was Rodrick Covington (RC). That he was not welcome at the Task Force and did not need to come out here. They (APD Inv.#503 and #504) left and went to their PD (police department) to get their buy money, when they returned we wired up the CI (confidential informant) and they all left to go and attempt to make a purchase. When they returned (APD Inv.#504) stepped in the door and stated to me (DTF employee) that (APD Inv. #501) may be coming out here (to the DTF Office). I (DTF employee) told him (APD Inv.# 504) that was not a problem as long as RC was not coming. As we were taking the buy equipment off of the CI, APD Investigator (#501) pulled up with RC Covington with him. They stepped out of the car and came into the office. RC stood at the door until we had finished with the CI. He then came into the office and kicked back on the couch. I (DTF employee) sent Assistant Commander (DTF Agent#802) and DTF Commander (Agent#801) a text message at 10:40am informing them both that he (RC Covington) was here (at the DTF Office). (DTF Agent # 802) stated to me (DTF employee) that he was on his way. When (DTF Agent# 802) arrived at the Task Force office he walked through the door and around to my desk. Myself (DTF employee), (APD Inv.#503), and RC Covington were in the front of the office at that time. As (DTF Agent# 802) went by he asked RC what he was doing out here and stated that he never expected to see his face out here since he threw (him DTF Agent#802) out of APD (Andalusia Police Department). RC stated that he did not kick him no f_____ where. (DTF Agent #802) stated to him (RC), yeah you and your chief did. RC then got loud and told (DTF Agent#802) that he needed to get his f______ facts straight before he said anything to him. (DTF Agent #802) came around the corner and told him (RC) to leave, that he (RC) was not going to disrespect him (DTF Agent#802) and talk to him that way in his own office. RC stated that he wasn’t going any f______ where. (DTF Agent#802) told him (RC) again to leave. RC yelled at (DTF Agent#802), “Why don’t you put me the f___ out!” (DTF Agent#802) told him that he could handle that. (DTF Agent#802) went to his truck and got his (Southern) Linc, he then called Command and requested deputies to be sent to the (DTF) office. He (DTF Agent#802) told RC that he was going to have him arrested for criminal trespass. RC stated, “Whatever, you do that!”

    While (DTF Agent#802) was on the front porch talking with Command, I stated to (APD Inv.#501) that he had to understand the animosity with RC. That nobody at the Task Force had a problem working with anyone at APD (Andalusia Police Department) except RC and that no one here would work with him (RC) because no one trusted him and because of all the trouble he had caused between all of the departments. As I (DTF employee) was talking to (APD Inv.#501), RC was saying to me (DTF employee), “You don’t know what the f___ you are talking about!” “You need to keep your f______ mouth shut!” and so on. (APD Inv. #501) turned around to him and told him, “RC shut up!” (APD Inv.#501) then pointed to the door for him (RC) to leave. As RC was going out the door he (RC) got in (DTF Agent#802’s) face and said, “F___ you (DTF Agent#802)!” and walked out and got in the car. (DTF Agent#802) and (APD Inv.#501) then had a few words in the front of the office, I (DTF employee) did not hear all of what was said between them due to the fact that I was on the (Southern)Linc with (DTF) Commander (Agent#801) trying to get him to the office and I (DTF employee) was on the office phone with Command because they called to make sure that we still needed the deputies, I (DTF employee) stated to them yes we did. By the time the deputies arrived (APD Inv.#501) and RC had left.

    Clerk’s Office by Drug Task Force Assistant Commander – (Agent # 802)

    Warrant/Summons Number – 13-46

    Case Number – 000130100491

    Defendant’s Name- Roderick Covington AKA: R.C. / Andalusia Police Department
    Statement of (DTF Agent 802) – January 16th 2013

    On the 16th day of January 2013, ______________ (the Drug Task Force Secretary) contact me (DTF Agent 802) via SouthernLINC and advised me that Andalusia Police Investigators (#503 and #504) were bringing a confidential informant to the Drug Task Force office. She (DTF employee) stated that they (APD Investigators) were going to use the Hawk video recording system during a detail which they were conducting. I (DTF Agent #802) was asked to assist them when they(APD Inv.) were finished with the detail. I (DTF Agent #802) was to download the video and transfer all video evidence to a DVD.

    At approximately 1041 MT (military time), I (DTF Agent #802) was en route to the office when (DTF Employee) contacted me (DTF Agent #802) and advised me the Rodrick Covington AKA RC, and (APD Inv# 501) were there, even though she had told (APD Inv#504 and APD Inv# 503) both that Rodrick Covington was not to come to the Drug Task Force Office.

    On arrival to the office, I (DTF Agent #802) walked inside and observed the RC subject seated on the couch, located in the lobby area of the office. As I (DTF Agent #802) entered the office I stated to the RC subject, “What are you doing here, I didn’t think you’d be around here after I was kicked out of the Andalusia Police Department.” The RC subject became verbally offensive and stated, “I didn’t kick you no f______ where!” I then responded, “Yes, you and your chief kicked me out or I should say had me kicked out!” The RC subject then stated, “You need to get your f______ facts straight before you say anything to me!” After that outburst of profanity I ordered the RC subject to leave. He refused. I told him a second time to get out of the office. The RC subject yell in a threatening manner, “Why don’t you put me the f___ out!” I stated, “I can handle that.” I then walked to my truck and retrieved my Linc to call the 911 center. I made contact with the 911 center and requested they send a deputy. I advised the RC subject that I would have him arrested for criminal trespass. He then stated, “Whatever, you do that!”

    (APD Inv. #801), who is in charge of the RC subject, and was allowing his subordinate to continue the verbal outburst, using offensive language towards me, motioned towards the RC subject. The RC subject the stood up walked over to where I was standing. At that point he positioned himself very close to my face and then stated, “F___ you ______________(DTF Agent #802)!”

    This was an apparent attempt to threaten and provoke me into a physical altercation. I then turned and asked _____(DTF employee), (APD Inv#503 and #504) if they had heard what the RC subject had said. All acknowledge, indicating that they had in fact in fact heard what the RC subject had said. The RC subject then followed (APD Inv #501) to their car. I then stated, “(APD #102 and APD Inv #502) will not be able to stop me (DTF Agent# 802) from going to Mayor Johnson and filing a complaint like they have been able to do with everyone else.

    (APD Inv #502) then came back inside. He and stated that he had nothing to do with what had been going on. He then stated that he built the Drug Task Force and has been slammed by several people in law enforcement. I (DTF Agent #802) stated that I was not concerned with that. He (APD Inv #502) was in the Drug Task Force long before me (DTF Agent 802), and had left the Drug Task Force long before I had started. I (DTF Agent 802) stated that I would not stand for being treated the way I was by anyone. He (APD Inv#502) stated that he was trying to be the bigger man and work with everyone, in order to get the job done. I (DTF Agent#802) then stated that I was all for that and that was the reason I had come to assist (APD Inv# 503 and 504). But that the RC subject’s actions were uncalled for and illegal.

    The RC subject, who is a lawfully sworn officer and a representative of the Andalusia Police Department and the City of Andalusia, did act outside the color of the law, exceeding the scope of his responsibilities and lawful authority which he is bound by, according to the laws of the State of Alabama. The RC subject’s action did violate state of law of Harassment 13A-11-8 (1) (b) and state law of Criminal Trespass III 13A-7-4.
    Furthermore, the RC subject who is a lawfully sworn officer and a representative for the Andalusia Police Department and the City of Andalusia, did act in a many which impeded me (DTF Agent 802) in the performance of my duties as the Assistant Commander for the Drug Task Force who was responsible for maintaining day to day operations on the 16th day of January 2013.
